Carefully Investigate into Every Case and Protect Human Rights

1. Carefully apply for detention Because detention deprives the defendants of their freedom, the prosecutors of this Office will allow people to post bail, release the defendants (either under the supervision of someone else or not), or limit the defendants living area if it is not necessary to detain the defendants.

2. Carefully issue the announcement of the circular orders for the arrest of criminals, timely revoke the orders when necessary and regularly complete the cases regarding the circular orders for the arrest of criminals. We will not issue the announcement of the circular orders for the arrest of criminals unless such criminals never appear in court after issuing subpoenas and efforts of arrest. We will use any method to find criminals and pay attention to the statute of limitations regarding the cases. We will revoke the circular orders if the statute of limitations has expired.

3. Strictly and quickly issue the warrant for communication surveillance. In order to avoid issuing too many warrants for communication surveillance and to protect the confidentiality of information, we have set up certain internal rules in reviewing the applications for warrant for communication surveillance strictly. We also keep related information carefully, take every opportunity to investigate into each case, and protect human rights.

4. Establish the two-way television interrogation system, the chatting room for the victims, and the defendant identification wall for the witness. In order to protect victims of sex offenses, we have a special investigation room for such sex offenses victims. This special investigation room is designed like a chatting room whose environment is warm and friendly. We also have facilities for young victims which make them easy to state the fact of the crime scene. In order to protect the safety of the informant and secret witness, we have established a defendant identification wall in a specialized investigation room in accordance with the order from the Ministry of Justice.

5. Establish the bail waiting room. In order to proceed with the bail procedure properly and protect people's freedom and dignity, we have toilet in the bail waiting room. We pay much attention to the light, ventilation and sanity of the room. We also provide telephone, stationery, desks, chairs, books, magazines, water, food, change for coins and information regarding the bail procedure.

6. Establish audio and video recording system in the investigation rooms and computerize all the investigation record. We have updated our audio recording system, proceeded with audio recording during the whole investigating procedure in our investigation rooms, and computerized all the investigation record. If it is necessary for certain cases, we will proceed with video recording during the whole investigating procedure in our investigation rooms to protect the rights of the parties.

7. Establish victim protection system. Since the effective date of the Criminal Victim Protection Act on May 27, 1998, we have established the "Committee for the Evaluation of Compensation for Criminal Victims" in order to actively push forward the protection of criminal victims. We engaged nine people including a divisional chief prosecutor, prosecutors, and other professionals in this Committee to be responsible for evaluation of compensation for criminal victims and other related matters. In April 1st, 1999, the "Association for Protection of Victims of Criminal Acts, Shi-Lin Branch" was established. This organization helps the victims to rebuild their lives, protects them from violence, and provides them with psychological, medical, legal and educational assistance.
